This privacy policy relates to
personal information obtained in the purchase of
flowers from the BuyAustralian.com marketplace.
All flower transactions are fulfilled by the Petals
Florist Network.
Petals Network is committed to the protection of
personal information in compliance with National
and International Privacy laws and in particular
the Australian Privacy Amendment Act 2001. Petals
Network will maintain the integrity of data collection,
use and disclosure, accuracy, security, openness
and access as outlined in the following document.
General
Petals will take reasonable steps to ensure that
personal information that is collected, used, or
disclosed is accurate, complete and up to date.
Petals will also take reasonable steps to protect
personal information that has been collected from
unauthorised access, modification or disclosure.
Petals will allow an individual to act anonymously
only where it is lawful and practicable to do so.
This information may pertain to 'individuals' as
defined by the Australian National Privacy Principles.
Petals will provide reasonable access to this information
and will not charge for acting on a request by an
individual not to receive direct marketing communications.
Customers
For the purposes of this document the 'customer'
is defined as a person that directly enters into
a contract with Petals Network for the delivery
of a flower or gift order to a 'recipient' who is
nominated by the customer. The 'customer' may be
an individual or non-corporate entity.
What type of personal information will be collected?
Petals will lawfully collect and store person information
from a customer that is necessary to complete the
order in a way that the customer would expect. Personal
information including name, phone number, e-mail
address and credit card details will be collected
when a customer places an order via the Internet,
by phone, by fax, by email or via a floral contractor
to Petals.
Cookies are used by the Petals Internet sites in
order to provide a high standard of service to customers.
A cookie is a small piece of text which is stored
automatically in the cookie folder of a browser
when a customer visits a web site for transaction
purposes. The text will make the customer identifiable
next time they transact with the site. Cookies are
also used by the Petals sites in order to identify
when an affiliate web site has been the source for
a transaction. Using cookies is standard and necessary
for many transactions on the Internet. They can
however be disabled changing the preferences of
their web browser but the effect on web site transactions
may be unpredictable.
How will the personal information be used?
Personal information collected from the customer
by Petals will be used for the primary purpose for
which it was collected, and for any secondary purpose
if it is directly related to the primary purpose,
or in a way that the customer would reasonably expect
the information to be used. The primary purpose
for collecting customer information is to send orders,
facilitate payment for an order, to provide feedback,
or to obtain further information about the recipient.
Credit card details will be used to process payment
for the transaction and information collected from
a customer that pertains to a credit transaction
may be disclosed to Petals and bank staff where
it is necessary and practicable.
Contact details may be used to provide feedback
to the customer and/or for the clarification of
delivery details, which is occasionally necessary
for the completion of the order. This information
may also be used to discharge a reminder service
to the customer at some time in the future if requested
at the time of ordering.
In order to provide a high level of customer service,
a record of order details is also stored to provide
an archive service which will be accessible from
the Petals web site some time in the future.
Recipients
For the purposes of this document the 'recipient'
is the intended receiver of a flower or gift contracted
by the 'customer' to Petals Network. The recipient
may be an individual or non-corporate entity.
What type of personal information will be collected?
Petals will lawfully collect and store personal
information about a recipient, as provided by a
customer, that is practicable to complete the order.
Personal information including name, address and
phone number will be collected by Petals about a
recipient when a customer places an order directly
with Petals via the Internet, by phone, by fax or
by email, or through a contractor that collects
the information on behalf of Petals.
How will the personal information be used?
Personal information collected about the recipient
by Petals will be used for the primary purpose for
which it was collected and for any secondary purpose
if it is directly related to the primary purpose,
or in a way that the customer and recipient would
reasonably expect the information to be used. The
primary purpose for collecting personal information
about a recipient is to facilitate the delivery
of an order. The personal information of the recipient
will be disclosed to a contractor that supplies
a floral delivery service for Petals Network, in
Australia or overseas.
Contractors
For the purposes of this document a 'Contractor'
is defined as a business that handles personal information
under a contract with Petals Network for the collection
and/or disclosure of personal information for a
benefit, service or advantage and so falls within
the definition of 'organisation'.
Personal Contractor Information
A Contractor may be an individual or non-corporate
entity. Petals will lawfully collect and store personal
information about a Contractor, as provided by the
Contractor, that is practicable and necessary. Personal
information including name, postal and street addresses,
phone and fax numbers, credit card and banking details
will be collected from the Contractor and used in
a way that relates to the primary purpose of collection.
The primary purpose for collecting personal information
about a contractor is for the payment of commission
or for the collection of monies owed by the contractor
and for enquiries related to the sending and receiving
of orders to and from the contractor.
Petals' Indemnity
All Contractors are required to take necessary
steps to protect personal information that is collected,
used and disclosed that would be equivalent to those
required by the Privacy Amendment Act 2001. Contractors
may be liable for any misuse of personal information
in relation to orders that are transmitted by Petals
Network.
Contax Magazine
Petals Network lawfully collects and uses personal
information for the distribution of Contax to florists
and others in the floral industry worldwide. This
information may pertain to 'individuals' as defined
by the National Privacy Principles. Petals may lawfully
use non-sensitive information for the secondary
purpose of direct marketing where it is impracticable
for Petals to seek an individual's consent prior
to this use. Petals will provide reasonable access
to this information and will not charge for acting
on a request by an individual not to receive direct
marketing communications.
Personal information held by Petals Network for
the distribution of Contax Magazine will not be
disclosed to any other party. Other organisations
may only access this information for mailing purposes
by placing advertising material in or with Contax
Magazine.
Please note that this site contains links to other
sites. Thawte is the provider of the the digital
(SSL) certificate used by Petals Network for credit
card protection (see credit card security). Thawte
is not responsible for the privacy practices, privacy
statements, or content of any other web sites.
Personal information held by Petals Network about
an individual can be made available upon request.
